This is difficult. You don't get to decide. I agree that the victim must be compensated and the perpetrator must pay reparations. But you cant just decide yourself otherwise we risk excessive repayments or punishments. For example I break a window of your house accidentally, can you decide the death penalty for me? In a libertarian society there would be judges to decide the outcome.
